By accessing or using SinoRX Medical Concierge services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services. We reserve the right to modify these Terms at any time, and your continued use of the Services constitutes acceptance of any changes.
2. Description of Services
SinoRX provides medical tourism coordination services, including but not limited to:
- Medical consultation coordination with partner hospitals in China
- Treatment planning and appointment scheduling
- Visa and travel documentation assistance
- Accommodation and transportation arrangements
- Translation and interpretation services
- Post-treatment follow-up coordination
Important: SinoRX is a medical coordination service, not a healthcare provider. We do not provide medical diagnoses, treatments, or medical advice.
3. User Responsibilities
As a user of our Services, you agree to:
- Provide accurate and complete information about yourself and your medical condition
- Maintain the confidentiality of your account credentials
- Notify us immediately of any unauthorized use of your account
- Comply with all applicable laws and regulations in your country and China
- Obtain necessary travel documents, visas, and health clearances
- Make your own informed decisions regarding medical treatments
- Arrange appropriate travel and medical insurance
4. Medical Services Disclaimer
You acknowledge and agree that:
- SinoRX does not provide medical services, diagnoses, or treatments
- All medical decisions are between you and the treating physicians
- We do not guarantee specific medical outcomes or results
- You are responsible for evaluating the qualifications of any healthcare provider
- Medical treatments carry inherent risks that you accept by proceeding
5. Fees and Payment
Our service fees will be clearly communicated before you commit to any services. Payment terms:
- A non-refundable consultation fee may be required to begin the coordination process
- Service fees are separate from medical treatment costs, which are paid directly to hospitals
- All fees are quoted in USD unless otherwise specified
- Payment methods and schedules will be agreed upon before services commence
- You are responsible for any bank fees, currency conversion charges, or transfer fees
6. Cancellation and Refund Policy
Cancellation terms vary depending on the services booked:
- Consultation fees: Non-refundable once consultation has been arranged
- Coordination services: Cancellation more than 30 days before travel: 80% refund; 15-30 days: 50% refund; less than 15 days: no refund
- Third-party services: Subject to each provider's cancellation policy (hotels, flights, etc.)
- Medical deposits: Refund policies are determined by the respective hospitals
In cases of force majeure (natural disasters, pandemics, government restrictions), we will work with you to reschedule or provide credits for future services.
7. Limitation of Liability
To the maximum extent permitted by law:
- SinoRX shall not be liable for any medical outcomes, complications, or results of treatments
- We are not responsible for the actions, negligence, or malpractice of any healthcare providers
- Our total liability shall not exceed the service fees paid to us
- We are not liable for indirect, incidental, or consequential damages
- We are not responsible for travel delays, visa denials, or circumstances beyond our control
8. Intellectual Property
All content on our website, including text, graphics, logos, and software, is the property of SinoRX or its content suppliers and is protected by international copyright laws. You may not reproduce, distribute, or create derivative works without our express written permission.
9. Privacy
Your use of our Services is also governed by our Privacy Policy. By using our Services, you consent to the collection and use of your information as described in our Privacy Policy.
10. Dispute Resolution
Any disputes arising from these Terms or our Services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with the rules of the Hong Kong International Arbitration Centre. The arbitration shall be conducted in English, and the decision shall be final and binding.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law provisions.
12. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
